1. Parties and Acceptance
These Terms of Service ("Terms") constitute a legally binding agreement between GoHire (Pty) Ltd (Registration No. [ATTORNEY: Insert company registration number]) ("GoHire", "we", "us", "our") and you, the registered user ("you", "your", "User").
By creating an account and ticking the acceptance checkbox during registration, you confirm that you have read, understood and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the platform.

2. Description of Services
GoHire is an online recruitment platform that connects:
• Candidates seeking employment opportunities in South Africa
• Employers seeking to fill vacancies
• Recruitment agencies seeking to place candidates with client companies

3. Account Registration and Security
3.1 You must be at least 18 years of age to register an account.
3.2 You must provide accurate, current and complete information during registration and keep your account information updated.
3.3 You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3.4 You must notify us immediately at legal@gohireco.com of any unauthorised use of your account.
3.5 GoHire reserves the right to suspend or terminate accounts that violate these Terms.

4. Credits, Subscriptions and Billing
4.1 GoHire operates a credit-based system. Credits are required to access certain features of the platform.
4.2 Credits and subscription plans are offered at the prices published on the platform at the time of purchase.
4.3 All prices are quoted in South African Rand (ZAR) and are inclusive of VAT where applicable.
4.4 Payments are processed by PayFast, a third-party payment service provider. By making a payment you also agree to PayFast's terms of service.
4.5 Credits are non-refundable once consumed. Unused credits may be refunded at GoHire's discretion within 7 (seven) days of purchase.
4.6 Subscriptions are billed monthly in advance. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused days.
4.7 Plan upgrades or downgrades take effect immediately. The prior subscription is cancelled and the new subscription commences on the date of upgrade/downgrade. No refund is issued for unused days on the prior plan.

5. Candidate-Specific Terms
5.1 As a candidate, you grant GoHire a non-exclusive licence to store, process and display your profile information and CV to registered employers and recruiters on the platform.
5.2 You warrant that all information in your profile is accurate and does not infringe any third-party rights.
5.3 You may set your profile visibility status at any time. A non-visible profile will not be shown to employers or recruiters.
5.4 You may request deletion of your account and personal data at any time in accordance with our Privacy Policy.

6. Employer and Recruiter Terms
6.1 Employers and recruiters may only use candidate data accessed through GoHire for the purpose of evaluating candidates for legitimate employment or placement opportunities.
6.2 You may not share, sell, transfer or use candidate data for any purpose other than recruitment.
6.3 Employers must comply with the Employment Equity Act 55 of 1998 and all applicable South African labour legislation.
6.4 Recruiters acknowledge that they act as information operators under POPIA when processing candidate data and must have their own POPIA compliance measures in place.
6.5 Job listings must be for genuine vacancies. False, misleading or discriminatory job listings are prohibited.

7. Intellectual Property
7.1 GoHire and its licensors own all intellectual property rights in the platform, including software, design, trademarks, and content created by GoHire.
7.2 You retain ownership of the content you submit (CVs, job listings, profile information). You grant GoHire a worldwide, royalty-free licence to use such content solely for the purpose of operating the platform.
7.3 You may not copy, reproduce, distribute or create derivative works of any GoHire content without our prior written consent.

8. Artificial Intelligence Features
8.1 GoHire uses AI technology to assist with candidate scoring, job matching and recruitment recommendations. AI-generated outputs are provided for informational purposes only and do not constitute employment decisions.
8.2 AI scoring and matching results are probabilistic and should be used as one input among many in recruitment decisions. GoHire does not guarantee the accuracy or suitability of AI recommendations.
8.3 Employment decisions must be made by qualified human decision-makers. GoHire is not liable for any employment decisions made on the basis of AI outputs.

9. Prohibited Conduct
You may not:
• Use the platform for any unlawful purpose
• Post false, misleading or fraudulent information
• Scrape, harvest or collect data from the platform by automated means
• Attempt to gain unauthorised access to any part of the platform
• Use the platform to discriminate against candidates on grounds prohibited by the Employment Equity Act
• Share your account credentials with third parties

10. Limitation of Liability

11. Termination
11.1 You may close your account at any time by contacting us at legal@gohireco.com or using the account deletion feature in your settings.
11.2 GoHire may suspend or terminate your account immediately if you breach these Terms, provide false information, or engage in fraudulent activity.
11.3 On termination, your right to use the platform ceases immediately. Unused credits are forfeited unless otherwise agreed.
11.4 Termination does not affect any rights or obligations that arose before the termination date.

12. Governing Law and Disputes
12.1 These Terms are governed by and construed in accordance with the laws of the Republic of South Africa.
12.2 Any dispute arising from these Terms shall first be referred to mediation. If mediation fails, disputes shall be resolved in the South Gauteng High Court, Johannesburg, or such other court as has jurisdiction.

13. Changes to These Terms

If you do not agree to the updated Terms, you may close your account before the effective date.
